1. General Terms of Use

By visiting gardensofelysium.com, you confirm that you are at least 18 years of age (or have parental/guardian consent) and agree to use this site for lawful purposes only. We reserve the right to refuse service, cancel orders, or restrict access to anyone who violates these terms or engages in fraudulent, abusive, or harmful behavior. We may update these Terms of Service at any time. Continued use of the site after changes are posted constitutes your acceptance of the revised terms.

2. Intellectual Property

All original artwork, paintings, ACEO miniatures, written works, and creative content available on this site are the exclusive intellectual property of Elysium by Kelsee and its creator. This includes, but is not limited to:

Original acrylic paintings and miniatures
The fantasy novel and all written content
Writing toolkits, digital downloads, and associated materials
Photography, branding, and site design

You may not reproduce, distribute, modify, or sell any content from this site without express written permission from Elysium's owner. Purchasing a physical or digital product does not transfer any intellectual property or copyright rights to the buyer.

3. Digital Products

Digital products (including free sample reads, digital toolkits, and downloadable files) are delivered electronically and are non-refundable once purchased. By completing a purchase of a digital product, you acknowledge and agree to this policy. Digital products are licensed for personal use only. You may not share, resell, or redistribute any digital files purchased from Elysium.

4. Physical Products

Shipping: Physical products are processed within 2–3 business days of order confirmation. Shipping timelines are estimates and may vary. Elysium by Kelsee is not responsible for delays caused by carriers, customs, or circumstances beyond our control.

Lost or Stolen Packages: Once a package is confirmed as delivered by the carrier, Elysium by Kelsee is not responsible for lost or stolen items. We encourage customers to ensure a secure delivery location.

Returns & Refunds: We accept return requests for damaged items within 2 days of delivery. To initiate a return, please contact us at creationsbykelsee03@gmail.com with multiple photos of the damage. Refunds are issued at our discretion after review. Items must be unused and in original condition. We do not accept returns for buyer's remorse or change of mind.

Baked Goods: Due to the perishable nature of food items, all baked good sales are final.

5. Limitation of Liability

To the fullest extent permitted by law, Elysium by Kelsee and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or purchase of our products. Our total liability to you for any claim shall not exceed the amount you paid for the product or service in question. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on this site.
